Who we are
Executry Solicitors Scotland is a service provided by Clarity Simplicity Ltd, trading as Simplicity Legal, a company registered in Scotland (company number SC380001), whose office is at 34 Woodlands Road, Glasgow G3 6UR. Clarity Simplicity Ltd is the controller of the personal information described in this policy.
Information we collect through this website
Website analytics
We use Rybbit, a privacy-focused analytics service, to understand how many people visit the site and which pages are useful. Rybbit does not use cookies or local storage for tracking. Visitors' IP addresses are hashed and anonymised rather than stored in full. We see only aggregated information, such as the pages visited, the website you came from, the type of device and browser, and your approximate location at country or region level. We cannot identify you from this information.
Maps
Some of our location pages show a Google Maps map of our office. When a page with a map loads, Google may receive your IP address and set its own cookies. Google's use of that information is governed by Google's privacy policy. If you would rather not load the map, you can use the office address shown on the page instead.
Cookies
This website does not set its own cookies, and we do not use advertising or social media tracking. Our fonts and images are hosted on this website, so viewing a page does not send your information to font or image providers.
Information you give us when you contact us
If you phone us, write to us, email us or send an enquiry through the form on our contact page, we will keep a record of your name, contact details and what you tell us, so that we can reply, arrange an appointment and give you advice. We use this information because you have asked us to, and to take steps before we agree to act for you.
The enquiry form on our contact page is provided through the website of Simplicity Legal, which is also run by Clarity Simplicity Ltd, so your enquiry goes directly to our team.
If you become our client
When you instruct us, we collect and use the personal information needed to provide our legal services, as explained in our terms of business and client privacy notice. In an executry, this can include information about the person who died, their family and the beneficiaries. We use it:
- to perform our contract with you and act on your instructions;
- to meet our legal and regulatory obligations, including the Law Society of Scotland's rules and anti-money laundering regulations, which require us to verify your identity;
- for our legitimate interests in running our practice, such as keeping proper records.
To carry out the work, we may share information with organisations such as the sheriff court, HM Revenue and Customs, Registers of Scotland, the Office of the Public Guardian, banks and other asset holders, law accountants, insurers providing bonds of caution, and identity verification or credit reference agencies. We share only what is necessary for the work.
How long we keep information
We keep client files for as long as we act for you, and afterwards for the periods set by the Law Society of Scotland and our own data retention policy. We review files after a period of at least 10 years from the end of our instructions. Enquiries that do not lead to instructions are kept for a shorter period.
Your rights
Under data protection law, you have the right to:
- ask for a copy of the personal information we hold about you;
- ask us to correct information that is inaccurate or incomplete;
- ask us to restrict how we use your information, or object to our use of it for our legitimate interests;
- ask us to delete your information, subject to the records we must keep under Law Society of Scotland rules.
To make a request, email legalteam@claritysimplicity.co.uk or write to us at 34 Woodlands Road, Glasgow G3 6UR. If you are unhappy with how we have handled your information, you can complain to the Information Commissioner's Office at ico.org.uk.
Changes to this policy
We may update this policy from time to time. The date at the top of the page shows when it was last changed.
